A serious debate over the setting up of a data privacy law has been doing the rounds for more than half a decade now. India has gone through several twists and turns in the quest to build a data privacy law framework that matches other mature jurisdictions worldwide. However, the more India comes close to making a robust data privacy law, the more it appears to be becoming a Sisyphean task. This article highlights how we are stuck in an endless loop when it comes to formulating the data privacy law in India.

Maharashtra Appellate Authority for Advance Ruling ("AAAR") has recently passed on order in the matter of Cummins India which has intensified the already existing confusion between the concepts of 'Input Service Distributor' ("ISD") and Cross Charge. While ISD and cross charge are two different concepts, they have been confused as alternatives to each other from time and again because both these concepts essentially entail ITC of common input services and apportionment of the same across branch offices located in different states. Before discussing the facts of the Cummins India case and analysing the implications arising out of the MH AAAR decision, let us first understand how GST law defines these two concepts.

The Competition Commission of India (CCI) in Re: Ministry of Corporate Affairs and Apollo Tyres and Ors by an order dated August 31, 2018 (CCI Order) imposed a collective penalty of ₹17.88 billion on five tyre companies and their association, i.e., Automotive Tyre Manufacturers Association (ATMA).

The Competition Commission of India ("CCI") in Re: Ministry of Corporate Affairs and Apollo Tyres and Ors.1 by an order dated 31 August 2018 ("CCI Order") imposed a collective penalty of INR 17.88 billion on five tyre companies and their association, i.e., Automotive Tyre Manufacturers Association ("ATMA"). CCI had imposed the penalty on the tyre manufacturers and ATMA for indulging in cartelisation, and contravening the provisions of Section 3 of the Competition Act, 2002 ("the Act").

The Union Budget, 2022-23 was presented by the finance minister, Ms. Nirmala Sitharaman before the Parliament on February 01, 2022. The budget did not include much expected propositions of pharmaceutical and medical device industry, such as extensive budget allocations and subsidies/incentives for R & D. However, the overall big plans such as to extend relaxations to start ups, proposal of national digitization of health records/system, announcement of national tele mental health campaign and support to newer businesses through proposed blended finance route is expected to bring about positive impact and activities in the industry.
